1. Acceptance of these terms

These Terms and Conditions ("Terms") govern your access to and use of the platform operated by Shree Bar Gam Samaj, a registered trust ("Samaj", "we", "us", "our"), under the name Shree Samast Bargam Samaj Unjha — comprising the website at https://bargamsamajunjha.com, the member portal, the admin panel, and the Android application (collectively, the "Platform").

By registering for, accessing, or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the Platform.

2. About the Platform

The Platform is a non-commercial, community-run service maintained for the benefit of the Bargam KP Samaj community. Its purposes are to maintain a community member directory, help families within the community discover one another (including for matchmaking and community events), distribute community announcements and welfare schemes, and provide community trustees and administrators with tools to keep records accurate.

The Platform is not a commercial service, a matrimonial agency, an advertising service, or a public social network. We charge members no fee for access.

3. Eligibility

Use of the Platform is strictly restricted to members of the Bargam KP Samaj community and the family members they register. By registering, you represent that you belong to this community (or are the parent/guardian of a person who does) and that the information you provide is true and accurate.

We may refuse, suspend, or remove any registration that does not meet this eligibility requirement.

Minors. A person under 18 may be included on the Platform only as a family member registered by a parent or lawful guardian who holds a member account. By registering a minor, you confirm you are that minor's parent or lawful guardian and consent on their behalf. Minors do not hold their own login.

4. Registration, approval, and accounts

You may register yourself by verifying a one-time password (OTP) sent to your mobile or email, then completing your profile. A community admin or the super admin reviews and approves or rejects each application. You can log in only after approval.
A community admin may add you directly, in which case your account is approved on creation.
You are responsible for the accuracy of the information you provide and for keeping it current.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorised use.
We may approve, reject, suspend, deactivate, or remove an account in accordance with these Terms and our community's rules.

5. Family members and registering others

A head-of-family member may register and manage information about family members (spouse, children, parents, siblings). By doing so, you represent that:

you are authorised to provide that person's information; and
where the person is a minor, you are their parent or lawful guardian and consent to the processing of their data on their behalf.

You are responsible for the information you submit about other people and for keeping it accurate.

6. Acceptable use

You agree that you will not:

use the Platform for any purpose other than legitimate community participation;
provide false, misleading, or impersonated information;
access or attempt to access data of members outside your permitted scope, or attempt to bypass the Platform's access controls or security;
harvest, scrape, copy, or extract member data in bulk, whether manually or by automated means;
use member contact details or photographs for marketing, solicitation, spam, harassment, or any commercial purpose;
upload content that is unlawful, obscene, defamatory, infringing, or that violates another person's rights;
upload malicious code or attempt to disrupt, overload, or damage the Platform;
use the Platform's matchmaking information for any unlawful purpose or in a manner that harasses or endangers any member.

The data available on the Platform is provided with limited rights and solely for the personal, community use of eligible members. Any other use is prohibited.

7. Member content, photographs, and licence

You retain ownership of the information and photographs you upload ("Member Content"). By uploading Member Content, you grant the Samaj a non-exclusive, royalty-free licence to host, store, display, and process that content solely for operating the Platform and delivering the community services described in these Terms and the Privacy Policy.

You represent that you own or have the necessary rights to the Member Content you upload, and that uploading and displaying it does not infringe any third party's rights. Where Member Content depicts another identifiable person, you confirm you have that person's consent (or, for a minor, parental/guardian consent) to upload it.

You may delete your profile and gallery photographs at any time through the member portal. When you do, or when your account is removed, those images are deleted from our storage.

8. Welfare schemes

The Samaj may publish community welfare schemes. Applying for a scheme is voluntary. By applying, you agree that:

the information and documents you submit are true and accurate;
the Super Admin may review your application and supporting documents to assess eligibility;
approval is at the sole discretion of the Samaj, and publication of a scheme is not a promise of any benefit; and
you may withdraw a pending application at any time.

Submitting false information in a scheme application may result in rejection and removal from the Platform.

9. Community standards and conduct

The Platform serves a community. You agree to interact respectfully with other members, to use information obtained through the Platform only for genuine community purposes, and to respect the privacy of other members and their families. We may remove content or accounts that, in our reasonable judgement, breach these standards.

10. Intellectual property

All Platform software, design, text, graphics, logos, and compiled community data (other than your own Member Content) are the property of the Samaj or its licensors and are protected by applicable law. You may not copy, reproduce, distribute, or create derivative works from the Platform or its contents except as necessary for ordinary, permitted use as a member.

11. Availability, changes, and discontinuation

We provide the Platform on an "as is" and "as available" basis. We may modify, suspend, or discontinue any part of the Platform, and may update these Terms, at any time. Material changes to these Terms will be communicated through the Platform, and your continued use after changes take effect constitutes acceptance.

12. Disclaimers

To the maximum extent permitted by law:

The Platform is provided without warranties of any kind, whether express or implied, including as to accuracy, completeness, fitness for a particular purpose, or uninterrupted availability.
Member-provided information (including profile details, matchmaking information, and photographs) is supplied by members; we do not independently verify it and are not responsible for its accuracy.
The Platform facilitates community connection and the sharing of matchmaking information; it is not a matrimonial service, and we make no representation or guarantee regarding any introduction, relationship, or outcome. Any decisions you make based on information from the Platform are your own responsibility, and we encourage independent verification.
We are not responsible for the conduct of any member, on or off the Platform.

13. Limitation of liability

To the maximum extent permitted by law, the Samaj and its trustees, administrators, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or inability to use, the Platform, including any loss arising from interactions with other members or reliance on member-provided information.

14. Indemnity

You agree to indemnify and hold harmless the Samaj and its trustees, administrators, and volunteers from any claim arising out of your breach of these Terms, your misuse of the Platform, or your infringement of any third party's rights, including in relation to Member Content you upload.

15. Suspension and termination

We may suspend or terminate your access to the Platform if you breach these Terms, provide false information, misuse member data, or act contrary to the community's interests. You may stop using the Platform at any time and may request removal of your account as described in the Privacy Policy.

16. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data and the rights available to you under the Digital Personal Data Protection Act, 2023.

17. Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, the courts at Unjha, Gujarat, India shall have jurisdiction over any dispute arising out of or relating to these Terms or the Platform.

19. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Samaj regarding the Platform.
